These Terms of Use govern the use of the website tortoris.com (the “Website”). By accessing the Website you accept these terms. If you do not accept them, please do not use the Website.

The Website is operated by C-URT GmbH, Ikenstr. 47, 40625 Düsseldorf, Germany (the “Operator”). Full provider details are given in the Legal Notice.

2. Purpose of the Website

The Website provides information about TORTORIS safety knives. It is not an online shop. No products can be ordered or purchased through the Website, and no prices are displayed. Requests for products, samples or quotations are handled individually by the contacts named on the Contact page.

3. Product information

Technical data, dimensions, weights, material descriptions, illustrations and application recommendations are provided for information only and are non-binding. They describe the products in general terms and do not constitute a guarantee of specific properties within the meaning of applicable law.

Products are subject to technical change. Illustrations may show a construction status that differs from current production, and printed or displayed colours may deviate from the actual product.

Binding product specifications result exclusively from a written quotation or order confirmation.

Application recommendations — including any indication of which materials a knife is or is not suitable for — are based on general experience. They do not release the user from assessing suitability for their own specific application.

4. Safety

The products presented are cutting tools. They must be used only for their intended purpose, in accordance with the instructions supplied and with the applicable occupational safety regulations. Personal protective equipment must be used where required by the workplace risk assessment. Keep the products out of the reach of children.

TORTORIS® is a registered trademark. All content on the Website — in particular texts, photographs, technical drawings, pictograms, logos and the layout — is protected by copyright and other intellectual property rights.

Reproduction, distribution, public communication or any other use beyond what is permitted by law requires the prior written consent of the Operator. Downloading and printing individual pages for your own, non-commercial use is permitted.

Distribution partners of TORTORIS may use the product images and texts of this Website for the purpose of selling TORTORIS products, provided the material is not altered.

6. Third-party trademarks

Trademarks and trade names of third parties mentioned on the Website are the property of their respective owners. They are used solely to identify products and do not imply any commercial connection or endorsement.

7. External links

The Website may contain links to third-party websites. The Operator has no influence on the content of those websites and accepts no responsibility for it. Responsibility for linked content lies solely with its respective provider.

8. Availability and liability

The Operator endeavours to keep the Website available and its content up to date, but does not warrant uninterrupted availability or that the content is complete, accurate and current at all times.

The Operator is liable without limitation for damage caused intentionally or by gross negligence, and for injury to life, body or health. In the case of slight negligence, the Operator is liable only for breach of a material contractual obligation, and in that case only for foreseeable damage typical of this type of use. Any further liability is excluded.

10. Governing law and place of jurisdiction

These Terms of Use are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Where the user is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is Düsseldorf, Germany. Mandatory statutory provisions on the place of jurisdiction remain unaffected.

11. Changes to these Terms of Use

The Operator may amend these Terms of Use at any time with effect for the future. The version published on the Website at the time of use applies.

12. Severability

Should any provision of these Terms of Use be or become invalid, the validity of the remaining provisions shall not be affected.
